I didn't do this.. and they should be able to track the IP of whoever did it right?.

I'd be calling and faxing the number on the whois too. Tell them that it has been fraudulently pushed to their account and you are seeking legal action..
When a HostGator is pushed upon purchase, sometimes it comes across to you unlocked, I don't know if it's because the original owner had it unlocked to start with or what, but it's happened to me. I.
Always.
Check to make sure any new purchase is locked..

Verify and update the contact information the moment they receive a purchased HostGator via transfer or push..
A lot of times the person who pushes the HostGator to you will push along their contact info with the HostGator (or some other incorrect info). Just because a HostGator was pushed/transferred to your account does not mean the correct contact information for you - including the ever important registrant contact email address - is properly assigned to the domain..
For TNQ.com, whois.sc history shows you, Jarrod, as the registered owner as of 12-27-05. It appears that any change of account for this HostGator is within the last week or two. Good luck getting it back...
Change your password immediately - it's always possible that someone somehow has your password...
If whois.sc is still showing you as the owner you should take a screen shot it could help you in getting it back..
This is just another reason to use godaddy. Godaddy Rockz!!!!..
FYI I've already posted this on my forum too and have people checking for trading activity..
Get in touch with the folks as eNom ASAP! They should have a record of when and how the HostGator left your account. Fortunately in this case they do have the one push per 7 day rule, so you have that window to find out what happened and correct it...
But isn't it the case usually that when a HostGator transfer is initiated the original Whois owner gets an email asking them if this is fraudulent?.
GoDaddy and 1and1 do that.....
Every time I sell a HostGator I get an email from Godaddy...
On 1and1 even when I have private reg - I still get email fwd'ed to my email address.... this is very strange that he didn't get any notification.
But as -RJ- mentioned you have 7 days to dispute the move, you will be ok assumming the hijacker has not sold it already or is not in the process of doing so....

I have seen this many times. It all comes down to the contact and registrant email address. This HostGator was placed in your account and after you confirmed receipt the email on file was not changed to yours, they pushed HostGator into another account..
I have on the odd occassion been in receipt of emails from registrars that I should not have had it's very easy to manipulate a persons account password and have complete control over an account..
I am a DNOA member and would never steal someones account.
But it is rather easy to do. And the person in control can transfer this HostGator to a registrar like Joker and it will be gone forever.
Just my 2cents. I wish you good luck in recovering this domain. Out of curiousity were any of your other domains effected?..

Sean Mullen is trying to resell a HostGator he already sold here on NamePros after hijacking it back from the purchaser? Yes, that doesn't bode well for remaining a member in good standing. If Sean was shorted by $2 and felt scammed, this was not the right way to handle the situation..

Premium - my advice is to contact first thing in the morning Enom and have a "folder of evidence" ready to be faxed. that should include the auction emails, the paypal receipt, and messages from this thread. If you fwd me your email address via PM i'd be happy to fwd you his email response asking me to go $12K for the domain... If nothing comes out of it (and I know it's not what you want but you can do charge-back on PayPal transaction).

Well, as with any HostGator transfer, if you do not change the admin contact email and the HostGator remains unlocked, all a previous owner has to do is instigate a transfer and he will receive the "approve email".. So, approve it and transfer back..
Not sure this has happened in this case, but I'm sorry to see such a valuable name go sideways like this...

Its slightly less of a crime if the money was returned but make a sale you are happy with, have others then tell you youve sold it too cheaply (including it seems the buyer) and then go return the money and reclaim the HostGator without informing the buyer....

Actually, I dont think it a bad price as well, it's certainly not the bargain of the century....
Personally, if Smullen doesnt feel like returning the HostGator despite the strength of feeling against his actions then this may be the only comfort you will gain from this...
But do keep us posted of developments, for if it transpires Smullen doesnt reconsider his actions, i, for one will not be doing any business with him in the future and if I see any of my friends/peers doing likewise, I will make it my business to let them know my feelings......

I just had a look at the sales thread, when the bidding difference between premium and tekz was $1 [the bids were $1701 and $1702], it's premium's fault to begin with, lets take facts into account, premium short changed the seller, the seller did push the domain, after acknowledging he was short changed he notified enom and reversed the HostGator transfer and refunded premium! Anyone see anything wrong here?..
I am sure RJ is investigating and we should wait and respect his final judgement call...

There is nothing ethically wrong with it, he was short changed, it was $2 it could have been $2,000 the fact remains he was short changed! The seller can ask for the $2 or cancel the sale altogether! There is no legal binding contract selling on namepros for both buyers and sellers, just code of ethics. Premium should be kicking himself for making the $2 mistake! If he sent the full amount then he would be the one who was right!.
You are over reacting, he didn't steal it if he refunded your money, it was your fault to begin with for not paying him in full, the $2 wouldn't matter if the bids weren't at $1701 and $1702 and you gave him $1,700!.
Btw, if he refunded you with paypal, paypal would / should refund all charges too including your $58!..

PayPal doesn't charge to do refunds. If it cost Sean $58 to receive the money, they will reimburse that $58 for the full transaction price goes back to the buyer. You should have the whole $1700 back in your PayPal account. Can you confirm this?.
There was a binding contract to sell the name to Premium for $1702. Why there seems to have been a complete breakdown in communication, I have no idea. The $2 short was obviously an unintential mistake by Premium, and should have been called out by Sean prior to sending the domain..
Instead, he accepted payment, transferred the HostGator and even left.

Jarrod had every right to assume the transaction was completed. At that point, both parties had accepted their consideration and ownership of the HostGator was legally transferred..

In the circumstances, there are a number of sensible options worth consideration such as giving the next bidder the.
Option to purchase or re-auctioning from scratch..
Re-auctioning was my preference because it seemed to be most fair, all factors considered..
I recall running that by a moderator who saw nothing wrong with that solution..

This thread was opened today, premium had been refunded days ago, calling the seller a thief is too much tbh, I put myself in the sellers shoes and I too wouldn't want to sell my name to someone who would make so much accusations after being refunded and not even pointing it out! I think he has a choice of what he wants to do with his domain, he doesn't HAVE to sell it to premium, premium had his chance and blew it! that's tough, he should be able to re-auction OR sell it to another bidder in the thread. I can't tell you enough how damaging opening this thread in public was for his sale!..
My guess is Smuller's reputation is not worth the thousands more he can make on TNQ.com, since I'm sure he has no intention of giving up the domain..
I'm sure it's his top domain, and if he can't trade on forums he'll still get a ton of money for it from someone..

Well I know one thing for sure...I will never do business with smullen again. I hope $2 is worth your reputation here at NamePros. Even if you did refund the money, it does not give you a right to steal the HostGator back. Lets compare this to a real life example. If I go to the store and buy a television for $1000, and when I pay, I only give them $998 by mistake, and then the cashier gives me the receipt, and I leave, the store can not come to my house and take the TV back because I didn't give them the $2. It is the store's responsibility to ensure that I paid the full amount.
This is the same case here. As soon as you pushed Premium the domain, the contract was completed. You accepted the amount of money he sent you as full payment for the domain, and then sent the domain. Very inprofessional, inmature, and possibly illegal action!..

If you read the thread from the beginning, Premium did not open this thread to just crash on smullen. All he knew was the HostGator he purchased was no longer in his enom account when he logged in today, and wanted to know what steps to take. He didn't even know it was smullen who had taken it when the thread was opened. Also, he had no idea he had received a refund when he opened the thread, though that doesn't really make a difference in my opinion..

I mean didn't it even occur to you to complain to paypal assuming this could have been a case of fraud? that would have frozen the money in his account!.

I don't believe you receive emails when you receive a refund. Perhaps it is his PayPal email settings, but I know in the past I have been refunded, and not known it until I logged in and saw it...
I dnt think he STOLE it back since he gave you a refund, you quite lucky he was honest to give you your money back. And he still owes you $58? Im quite sure he doesnt, paypal give it all back. And when he gave you the refund, you MUST of know, as you get emails etc. You should of given all details when starting the thread..
It happened to my cousin once .... on domainsite ... 15 of his domains were transferred to one hijacker's account ... he reported in 30 mins and they gave him the password of that user's account to transfer the domains back because he had a very good reputation there and he also knew alot of staff members. I'd say report it to enom and they'll give you the HostGator back.

Can I ask, did this payment to Paypal come directly from your bank account or from a credit card or even a like a Visa debit card? If it did come from a credit card, you do have some recourse. My wife use to work for a credit card processing agency, they have entire departments dealing with fraud. That's basically what this is. You have an auction, an agreed upon price, a sell, receipts of that sell, and positive feedback left for you for the transaction... yet you don't have the domain. Even if there is a $2 problem hanging over this, the exact moment Smullen accepted the Paypal payment, that $2 dollars didn't matter anymore.
When he accepted payment, he also accepted that statement..
If this is the case, do as Maroulis said, put together a "package" of all of this... the auction, the positive feedback, the Paypal receipts, everything and contact the credit card provider. Believe me, they have an entire legal department that takes care of things like this..
But..... If it came directly from your bank account, I'm afraid there really isn't much you can do except hope that this guy gives it back...
The legal department is not really for internet fraud, all they do is back charge possible internet fraud cases, they don't really investigate them, even if they do the credit card company can't do anything but to recover his funds which is already refunded days ago before this thread was even opened! Don't expect the credit card company to take legal action on this, unless this was a $100,000 deal and they were sure smullen was wrong and premium was fully cheated which isn't the case here!..

If smullen made a thread after the sale about premium not paying the full amount (which he already posted on the same sales thread which was closed!) the majority of opinions would be backing him now instead of premium, we should acknowledge both were wrong, you can't say premium was right all along and smullen was the villain here! and I think it's wrong encouraging premium to complain to his credit card company, he should be informed they will do nothing for him and these complaints do go into your record and possibly your credit record, if you are seen to back charge alot you will be a liability to the credit card company..
I hope premium learned his lesson, to maintain his excitement on his next big bargain and check how much he pays the seller! You may have degraded smullen's reputation but you sure didn't increase your own reputation by making this thread. As soon as you found that you were refunded this whole case of I was robbed etc. should have been stopped, taking it further is just childish. First of all if smullen had created a thread about Premium shorting him $2, I'm sure Premium would have just acknowledged his mistake, and sent the $2. You don't pay $1700, and then all of a sudden go cheap on someone for $2. Also, I completely disagree with you that Premium has damaged his own reputation with this thread. You saw smullen's reaction to Premium's questions...he just was immature and called Premium names. If Premium had dealt with this in a private manner, it would have been all name calling, and nothing would have gotten done. This way, in a public medium there is a chance of something getting done, or at very least if Premium is unable to get the HostGator back, that is rightfully his, smullen can have a ruined reputation, and be banned...

What smullen did was wrong, and deserves nothing, no apology from anyone..
2) Smullen used Premium's being $2 short as an excuse to sell the HostGator again at a higher price. Any other Namepros member would have said "hey, did you realize you were $2 short, please send." Some Namepros members woudl have said "$2, big deal, forget it.".
3) I, as Premium, would have done the same. I would have made sure the HostGator was transferred to me. The last thing I would be doing is going to PayPal to see if I had gotten a refund. Why would I do that? I just bought a domain, not returned one..
4) This kind of behavior is nothing more than being chicken, well, I'll use the word poop! We don't need people like that in Namepros..
If Smullen can prove everybody wrong, well, at that time, we will owe him a big apology. Of course, this is all my own honest opinion from what I see, and feel..

It's hard to stay calm when someone does you wrong, but you have no idea how much you've learned from this one bad transaction. I would be happy that I got my money back after a deal like this, there have been times I didn't..

Premium, FWIW I had a similar problem a few months ago. Bought a 2 char org HostGator on eBay, and the seller refused to complete the sale. The seller set no reserve and it went for a fraction of what it was worth, so he flat out bailed on the deal. My email exchanges with him were quite unpleasant and unproductive..
I think your options are about the same as mine were. It sucks, but don't let it waste your time..

I think it is up to Enom and other authorities now, Smullen is obviously being very stubborn and it doesn't look like he'll be giving up the HostGator soon. So I am taking this very seriously, and I'm going to do whatever it takes. For all of you who say tough luck, think again..
And Yes Frank is right, It's December 26th when I did this deal, it was boxing day, I was visiting with friends/family. On new years I was doing the same, these last few weeks I was very busy and didn't have much time..

This is very impossible to happen, is this hacked event? usually registrars will only listen to the person listed as the admin contact of the HostGator or the support contact, do you hold one of those? do you have proof that it was transferred to you as you as the admin, billing or technical contact?..
Fax or email to enom as attachment as proof then call them after your email is done...

Badger I have put together a service calle dNP PROTECT RJ and I have gone over it but to be an escrow service you must be a licensed escrow service without that it means nothing and RJ has to decide to open Himself up to liabilty in that case too. NP Protect can work as a very efficient system from an ethical standpoint though..

Let me tell you a story, I bought a mobile phone from dialaphone, they charged me LESS for the mobile than it was worth, (it was their mistake and not mine) after a month I got a letter to send the phone back or legal action will be taken to recover the phone, I sent it back. This was bad business practice by the phone company but they had every right to recover their position because they had refunded my credit card and even sent me a prepaid envelope to give the phone back..
If I sold something for $1 million and there were 2 bidders, one bidding $999,999.50 and the other bidding $1,000,000 and the highest bidder paid me $999,999 in short terms I wouldn't be happy at all, it's not the money, it's the fact that he paid less than the previous bidder too!..

What would they take you to court for exactly?? You claim this happened, what then are the circumstances?? Contract law = offer, acceptance and consideration. They offer at a price, you accept that price, you pay them the consideration.. End of!.
3. If we take it as read that 1 cannot happen without 2, when exactly were the debt collectors gonna come round to take back your phone??.

You misunderstood the entire situation, the phone was a contract phone say for 20 per month, they charged me 2 per month, it was their mistake but they had the right to recover the phone. If a you cash a check in the bank for 5,000 and the bank gives you 50,000 does the bank not have the right to recover their money? I never pretended to know much about law, but I sure know the basics..
Going back to topic, Smullen had the right to recover his HostGator after refunding premium..

Whether that contract is realistically enforceable or not is another matter..
I always thought a seller will push over, or transfer, a name over to a buyer if they agree to a deal. This is an explicit and deliberated show of acceptance for the transaction, I would have thought..
It may have been a bad mistake to do this; seller's remorse, a change of mind, a sudden realization, whatever. But a deal is a deal, and transactions close when consideration is given by BOTH parties, and the final act of handing over the name is activated..
To extract a name from another's account without due notice and mutual agreement is tantamount to theft. Can you imagine the chaos and mistrust this will cause if all sellers did this reversing of pushes for arbitrary reasons or cock-and-bull stories they invent, or sellers remorse?.

I sleep very well at night knowing my transactions go through Escrow and not PayPal. PayPal is good for deals around $2-$500, anything after that I use Escrow, and the buy pays the fee (unless it’s a whopper of a sale, then I’ll bend my rules)...

First: Definitely what was done here was wrong on the part of Smullen, unless there is some part to the story that we (I) have not heard yet..
Second: Legal action would be somewhat pointless unless your goal is to cause an inconvenience for him, as you have not been "harmed" to any great extent. While there might be punitive consequences from PayPal, etc., I seriously doubt you can force specific performance (The transferring back of the domain) through any legal channels (And enom would actually be incorrect in doing so here, if they do, in fact, have a 1 week push policy...)..
Third: Assuming we have all the facts before us, Smullen's correct course of action should be to accept full payment for the name and to transfer the HostGator to premium..
HOWEVER: I want to make it clear (And I think we all know), that having a cool head when the stuff does hit the fan helps to keep folks on your side. Keep all posts, even those that tell how you have been horribly wronged, civil and slander (Not the legal term here) free..
Smullen, if you're reading this: Do the right thing. PM me if you have questions or further info somehow..

Whats this 7 day rule with enom anyways how come in the years here we have never heard about this happening, how can we do trades and sleep with peace ? how can we even trade or sell domains with this type built in bomb within the network of selling domains, this will give the wrong impression that people are allowed to do this it has to be snipped in the bud before this gets out of hand,,,, what if this becomes a common place accurance happen now and then since the word is out that this is allowed...
This event may stipulate a new grounds in HostGator laws that need to be looked at by the councel HostGator judges and icann..

I have provided enough evidence that Enom has pushed my HostGator back into my account. The HostGator is under my control, it's locked, the whois is being updated to my information. Sean will not be able to touch this HostGator again..
As of now I will send the money back to Sean including the $2 extra (trust me I don't feel like he deserves it after what he did, however it's the right thing to do)..
All I ask from Sean is an apology..

Did they give any insight on how he was able to take the name in the first place? I'm equally concerned about this 7 day rule, that if it is true that you can reverse a HostGator transfer without notifying the current holder this opens the door for more fraudulent transactions...

Well, I am amazed!! this thread over the last 72 hrs has been a train wreck that I just couldnt stop watching. I would wake up in the middle of the night and logon just to see what was happening. all over $2.

One "feature" of a retail account is that your upline reseller can - without knowing your password - enter your enom account and do anything you can do, which includes pushing domains. Who's your upline reseller?.
You should seriously consider getting a reseller account. If you don't want to spend for a discounted account, there are several who can provide you with $8.95 accounts for free. Again, pick your upline reseller with care, as he still would have some oversight on your account, such as pricing and info on what domains you are registering...

Ian, uplines have full do-anything access to their downline retail accounts, but.

To their downline resellers. Access to downline resellers is very limited, as these folks are assumed to know what they are doing and have no need for assistance..
It happened a couple of times where my nameservers on some domains changed to that of my upline reseller, so he could have stolen my traffic. But the traffic on those domains was minimal, so I simply assumed this to be a bug. Besides, after I reported it to enom, the problem was corrected and I never saw it happen ever again..
If you want to be totally safe, signup directly from enom, and park all your names there. When renewal time comes, push to your cheap acct, renew, then push back to your no-upline account. I don't do this myself, though - too lazy...

Great news!! This goes to show all of us " a deal is a deal." You can't change your mind afterwards, because you were offered more money for your domain! The fact that you were $2 short should not even be a factor in this transaction. It's not like Smullen didn't know where you were at, and couldn't collect the $2..
However, at the same time, make sure you send the correct amount agreed to in the transaction! Look how much grief $2 cost you!! (I mean this in general, for every Namepros memeber).

I said it before, I am nobody here (just look at my rep). But the fact that Smullen pushed the HostGator in the first place says to me that he was OK with getting the extra $2.00 from Premium later..
The Indian Giver crap never flies well. A deal is a deal as it should be. Smullen could have always contacted Premium directly through email or PM. I bet he even had other contact info. Posting an arbitray thread that Premium may or may not find was simply laying ground work for excuses..
I always feel better when Intellectual Property is treated as such. We are all putting values on these Domains constantly, but the fact is that my TM names meant so much to me that I had absolutely no choice but to take control of them since the big registrars so obviously got too big and blatantly did not give a rat's *** about my precious, priceless (to me) business & brand Trademark names..
Now as a HostGator (and hosting and internet services, etc..) reseller I can finally sleep at night knowing that Net Sol doesn't have my names to blackmail and torment me with. (I mean that, literally).

It worries me that some ENom accounts are insecure the upline can push your domains etc..
I'm a fan of Godaddy especially as by using their discount codes etc, you can register domains for $4-$5 per year. They also have 24 hour phone support so they are never closed...

You lost your eNom login? Where did you get the eNom account in the first place? If Sean created it for you, he may still have access to it as your parent reseller. Put it in your own eNom reseller account now! If you need one, create one here.

Reseller accounts do not let anyone else change your domains, while retail accounts do allow your parent reseller to retain management abilities..
A registrar transfer might is not a bad idea, since you don't know how it was able to leave your eNom account in the first place...

Anyways I received an email from Enom today and this is what they said:.
The former account holder contacted us and claimed he had pushed the HostGator "by mistake". The person who pushed it back is fairly new here and did not understand that it is our policy to refer these requests back to the original account holder..
So it was a mistake, and Enom fixed it, they said they have informed all Enom support staff about this, and it shouldn't happen in the future..
This is a very dirty way to steal a HostGator back. Anyways I hope it's all over now, if the staff would like me to ask Enom anymore questions, please PM me..

What were saying here, not being condescending, but if you are under a reseller account and you are listed as a retail account under that reseller, then the reseller can access your account and do what they want with your domains..
If, in this instance, you are under the seller then he can simply access your account and move the HostGator again. Worst case scenario trnsfer it to another registrar that is of the "i dont give a damn" school - joker *cough dot com for example....
